Welcome to VisaPrep ("we", "our", "us"). By accessing or using our website (visaprep.com.au) and our software platform, you ("the User", "you") agree to be bound by these Terms of Service. If you do not agree to these terms, you must not use our services.
1. Nature of the Service (Not Migration Assistance)
VisaPrep is exclusively an organizational, formatting, and productivity software tool. We are not a law firm, and we do not provide legal advice or "immigration assistance" as defined under Section 280 of the Migration Act 1958 (Cth).
By using VisaPrep, you acknowledge and agree that:
- We do not assess the merits, strengths, or weaknesses of your individual visa application.
- We do not advise you on which visa subclass to apply for, or whether you meet the legal requirements for any visa.
- We do not represent you before the Department of Home Affairs, the Administrative Appeals Tribunal, or any other government body.
- Any structural guidelines, 4-pillar checklists, or document formatting rules provided by VisaPrep are based purely on publicly available information from the Department of Home Affairs and do not constitute tailored legal advice.
If you require legal advice or immigration assistance regarding your specific circumstances, you must consult a legal practitioner or a Registered Migration Agent certified by the Office of the Migration Agents Registration Authority (OMARA).
2. User Responsibilities & Application Outcomes
You are choosing to prepare and lodge your own application (a "DIY" application). You retain 100% responsibility for the contents, accuracy, and timely submission of your visa application to the Department of Home Affairs.
VisaPrep does not guarantee that your visa application will be approved. The final decision rests entirely with the Department of Home Affairs. We are not liable for any delays, Requests for Further Information (RFIs), visa refusals, or financial losses (including lost government application fees) that result from your application.
3. Account Security and Data Management
You are responsible for maintaining the confidentiality of your account credentials. While VisaPrep utilizes secure, industry-standard infrastructure to store the documents and data you upload to our workspace, you must maintain your own local backups of all personal documents, evidence, and forms. VisaPrep is not liable for any data loss, corruption, or temporary lack of access caused by server outages, technical failures, or user error.
4. Payments and Refunds
Fees: Access to premium VisaPrep software tools and workspaces requires payment as outlined on our pricing page. All fees are in Australian Dollars (AUD).
No Refunds for Visa Outcomes: Because VisaPrep is an organizational software tool and not a legal service, we strictly do not offer refunds in the event that your visa application is delayed, scrutinized, or refused by the Department of Home Affairs.
Software Refunds: Refunds for software access will only be provided in accordance with your rights under the Australian Consumer Law (e.g., if the software is fundamentally defective and cannot be fixed within a reasonable timeframe).
5. Intellectual Property
All checklists, structural frameworks, software code, UI designs, and proprietary text provided by VisaPrep remain the intellectual property of VisaPrep. You are granted a limited, non-exclusive, non-transferable license to use these materials strictly for the purpose of organizing your own personal visa application. You may not copy, resell, or distribute our frameworks or software.
6. Limitation of Liability
To the maximum extent permitted by law, VisaPrep and its founders, employees, or affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, loss of visa status, or deportation, arising out of your use of or inability to use the service.
In no event shall our aggregate liability exceed the total amount paid by you to VisaPrep in the twelve (12) months preceding the claim.
7. Modifications to the Service
We reserve the right to modify, suspend, or discontinue any part of the VisaPrep service at any time. We will attempt to notify users of any significant changes, particularly those that may affect the storage of your uploaded evidence.
8. Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of Queensland, Australia. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts located in Queensland.
